 Family Educational Rights and Privacy Act (FERPA)

 

As of January 3, 2013, all Applications to Conduct Research in the Hawaii State Department of Education (HIDOE) have a FERPA training requirement.

Beginning June 1, 2013, applicants must submit a Certificate of Completion for “FERPA 101: For Local Education Agencies,” a training course developed by the U.S. Department of Education’s Privacy Technical Assistance Center, for the research project’s principal investigator(s).  

Signed copies of the document “Acknowledgement of the Implications of the Family Educational Rights and Privacy Act (FERPA) in the Context of K-12 Education” will no longer be accepted.

 FERPA 101 Training

 

The "FERPA 101: For Local Education Agencies" training video is available at http://ptac.ed.gov (scroll down to the “Training Videos” section near the bottom of the page).  It provides an overview of FERPA in the context of K-12 education and ends with a quiz. 

Once an individual has successfully completed the quiz, the website will issue a Certificate of Completion.  This certificate should be uploaded to Tab 6 of your application.

Please note that:

  • Certificates will be accepted for up to three (3) years from the certificate date and must be valid on the application’s initial submission date.

  • Certificates must be submitted for all principal investigators of the research project for which you are applying for approval.

In cases in which there is more than one principal investigator, please combine all of their certificates into a single PDF and upload this document to your application.

 

 FERPA-related Requirements

 

In addition to the FERPA training requirement, as stipulated by the Affirmation Form for Researchers: 

1.     All researchers must ensure that their research project and the handling of the data collected and/or received as a part of the conduct of their research project are in compliance with all relevant federal and state laws and regulations pertaining to information confidentiality and security and the privacy and use of student and personnel records, such as FERPA.

2.     At least two (2) weeks prior to printing, publishing or otherwise publicly releasing the final report on the research project, submit electronic copies of a final draft to:

a.     The administrators of the participating schools and offices for their review, and

b.    If the research project involved either participants who are Hawaii State Department of Education (HIDOE) students or personnel or the collection and/or receipt of personally identifiable HIDOE student or personnel data, to the HIDOE Data Governance Office to be screened for the inclusion of personally identifiable HIDOE student and personnel data.

3.     If the Project involves either

a.     participants who are HIDOE students or personnel or

b.    the collection and/or receipt of personally identifiable HIDOE student or personnel data

it may be subject to a random audit by the HIDOE Data Governance Office — either during its implementation or after its completion — to determine whether the research project, the project staff, and the handling of the data are/were in compliance with the processes, procedures and conditions for conducting research in HIDOE described in the Affirmation Form for Researchers, as well as all relevant federal and state laws and regulations pertaining to information confidentiality and security and the privacy and use of student and personnel records.
